An Ability to Pay Request for Evidence is issued when U.S. Citizenship and Immigration Services questions whether an employer can pay the wage offered in an H-1B or employment based petition. This type of review focuses on the financial condition of the company rather than the qualifications of the beneficiary.

USCIS typically examines financial records such as tax returns, annual reports, and financial statements. If reported income appears low or inconsistent with the offered salary, officers may question whether the employer can meet its wage obligations.
